1. Acceptance & Eligibility

• Binding Agreement: By accessing DIPALE AI (the "App"), you agree to these Legal Terms. If you disagree with any part, you must immediately cease usage.
• Primary Account Holder: The account must be created by a person at least 18 years old ("Primary Account Holder"). You are responsible for all activity under your account, including the conduct of any minor you authorize to use the App.
• Child Access: Users under 13 must use the App only with direct parental or guardian supervision.

2. Subscriptions & Billing (Mobile Terms)

• Auto-Renewal: Subscriptions (Monthly or Yearly) auto-renew at the end of each billing cycle through your mobile App Store (Apple/Google).
• Cancellation: You may cancel auto-renewal at any time via your App Store settings at least 24 hours before the current period ends.
• Refund Policy: To the extent permitted by law, all subscription fees are non-refundable once the billing period has commenced.
• Data Charges: As a mobile app, you are solely responsible for any data costs or mobile carrier fees incurred while using DIPALE AI.

3. Intellectual Property: The "AI-Human" Split

• DIPALE AI Ownership: We own the App’s source code, databases, design, and underlying AI models.
• Your Contributions: You retain ownership of your original story prompts and creative ideas ("Input").
• AI-Generated Output: We assign to you all our right, title, and interest in the specific stories and characters generated for you ("Output").
• Notice on Copyright: Please note that purely AI-generated content may have limited legal copyright protection in some jurisdictions.

4. User Representations & Eligibility

By using DIPALE AI, you warrant that:

• You possess the legal capacity to abide by these terms.
• If you are under 18, you are using the app with the consent and supervision of a parent or guardian.
• You will not access the Services through automated means (bots, scripts, etc.).
• All information provided for account creation is accurate and truthful.

5. Prohibited Activities

To maintain a safe environment for families, you are strictly prohibited from:

• Systematic Extraction: Using bots or scripts to scrape data or "crawl" the story database.
• Security Interference: Bypassing or disabling security features that restrict the copying of content.
• Malicious Use: Uploading viruses, Trojan horses, or engaging in "spamming" (repetitive text) that disrupts the service.
• Harassment: Using the platform to bully, threaten, or harm our employees or other users.

6. Image Upload & Character Creation Policy

To protect children and maintain a safe environment:

• The "One Face" Rule: Only clear facial images of a single person are permitted.
• Automated Screening: All images are subject to automated screening technology. Non-compliant images (scenery, pets, group shots) will be rejected.
• Permissions: You must only upload images you have explicit permission to use.

7. User-Generated Contributions

• Ownership: You retain full ownership of the story text and creative content you provide.
• License to Us: You grant us a license to process, store, and display your contributions solely to provide the app’s functionality.
• Responsibility: You are exclusively accountable for your contributions and agree to reimburse us for losses resulting from your violation of third-party rights.

8. Term, Termination, and Modifications

• Right to Terminate: We reserve the right to deny access or terminate accounts at our sole discretion, without notice, for any breach of these terms.
• Service Changes: We may modify, update, or discontinue any part of the app at any time without liability.
• Interruptions: We do not guarantee 100% uptime. We are not liable for any loss or inconvenience caused by service downtime.

9. Disclaimer & Limitation of Liability

• "As-Is" Basis: The services are provided "AS IS". We disclaim all warranties, including implied warranties of merchantability or fitness for a particular purpose.
• AI Disclaimer: AI output may contain inaccuracies or "hallucinations". Parents are responsible for reviewing all generated content.
• Liability Cap: To the fullest extent permitted by South African law, our liability is limited to the amount paid by you to us, if any, for the services.

10. Governing Law & Dispute Resolution

DIPALE AI is provided “as is.” We are not liable for:

• Jurisdiction: These terms are governed by the laws of the Republic of South Africa.
• Informal Negotiations: Parties agree to attempt informal negotiations for at least 14 days before initiating formal proceedings.

11. Electronic Communications & Signatures

Using the app or sending emails constitutes electronic communication. You consent to receive communications from us electronically and agree that electronic signatures, contracts, and records satisfy all legal requirements for written documentation.
